Terms of Use

Last updated: November 7, 2026

These Terms of Use apply to the Virginia Cannabis Clinic website, virginiacannabisclinic.com, and to the telehealth services you book through it. They’re offered by Elevera Health PLLC, doing business as Virginia Cannabis Clinic (“we” or “us”). By using this website or booking a visit, you agree to these Terms and to our Privacy Policy.

1. Website content is not medical or legal advice

  • Everything on this website, including articles, FAQs and descriptions of Virginia law, is for general information only. It isn’t a substitute for professional medical advice, diagnosis or treatment, and it isn’t legal advice. Laws about cannabis change; check the Virginia Cannabis Control Authority for current rules.
  • Using this website, filling out the contact form or messaging us doesn’t make you a patient or create a practitioner–patient relationship. That relationship begins only when you complete your telehealth visit with one of our practitioners.
  • In an emergency, call 911 or go to the nearest emergency room. Our website, contact form and messaging aren’t monitored for emergencies.

2. Who can use our services

  • You must be 21 or older.
  • You must be a Virginia resident with a valid government-issued photo ID, and you must be physically located in Virginia during your telehealth visit.
  • You agree to give us complete and accurate information about your identity, residence, location, health history, medications and current treatment. Giving false information to obtain a certification may be unlawful and is grounds for us to end care and void the certification.

3. Our telehealth services

  • Visits are live telehealth video and audio visits with a licensed practitioner, as Virginia law requires.
  • Your practitioner decides, using their professional judgment, whether you have a diagnosed condition that may benefit from medical cannabis. A certification is never guaranteed. Your practitioner may decline to certify you or may ask for medical records or other information first.
  • A written certification lets you buy medical cannabis from a licensed Virginia dispensary. It does not tell you which product or dose to use; the dispensary pharmacist can help with that. Results vary and we don’t promise any specific result.
  • A certification is valid for one year. You’re responsible for recertifying before it expires if you want to keep buying from a dispensary.
  • We are not a dispensary. We don’t sell, grow or deliver cannabis, and we aren’t affiliated with or paid by any dispensary or the Virginia Cannabis Control Authority.
  • Telehealth has limits. Your practitioner may recommend that you see your primary care provider, a specialist, or urgent or emergency care. We don’t replace your regular doctor.

4. Fees and payment

  • Our visits are self-pay. We don’t accept insurance. Current prices are on our Our Services page; the price that applies is the one in effect when you book. Veterans receive the discount shown on that page.
  • Fees are for the practitioner’s evaluation, not for a certification. If your practitioner determines that you don’t qualify for a certification, you won’t be charged for that visit (or your payment will be refunded).
  • Once your visit is completed and a certification is issued, the fee is non-refundable, except where the law requires a refund.
  • Recertification pricing is only for existing patients of Virginia Cannabis Clinic.

5. Cancellations and missed appointments

  • Please cancel or reschedule at least 24 hours before your appointment, using your booking confirmation or by messaging us in Spruce.
  • If you miss your appointment or join more than 10 minutes late, we may need to reschedule you.

6. Your certification and the law

  • Your certification is issued under Virginia law only. Other states don’t accept it, and you must not take cannabis across state lines.
  • Cannabis remains a controlled substance under federal law. A Virginia certification doesn’t protect you under federal law, including on federal property, in federal housing, when buying a firearm, when traveling by air, or for federally regulated jobs (such as commercial driving, aviation or some security clearances).
  • A certification doesn’t require your employer to allow cannabis use at work or impairment on the job, and it isn’t a defense to driving under the influence. Never drive or operate machinery while impaired.
  • You’re responsible for following the law about possessing, storing and using cannabis, including keeping it away from children and pets.

7. How we communicate with you

  • We may contact you by phone, text message, email, Charm Health or Spruce about your appointments, your certification and billing. We don’t send marketing messages.
  • Your certification is sent to the email address you give us. Email isn’t always secure; please make sure the address is correct and private to you. Tell us if you’d prefer to receive it another way.
  • For questions about your health, use Spruce rather than email or the website contact form.

8. Acceptable use of this website

Don’t misuse this website. That includes trying to get into parts of the site or our systems you’re not allowed to access, interfering with the site, sending spam or malicious code through our forms, or scraping or copying our content in bulk.

9. Our content

The content on this website, including text, graphics, photos, logos and design, belongs to Elevera Health PLLC or its licensors and is protected by copyright and trademark law. You may view and print pages for your own personal, non-commercial use. Any other use requires our written permission.

10. Other websites and services

Our website links to services run by other companies, such as our booking system and patient record (Charm Health), Spruce, the Virginia Cannabis Control Authority, dispensaries, review sites and social media. Those services have their own terms and privacy policies, and we’re not responsible for their content or practices.

11. Disclaimers

To the extent the law allows, this website and its content are provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose and non-infringement. We work to keep information current, but laws, prices and availability change, and the site may contain errors or be temporarily unavailable.

12. Limitation of liability

To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages arising from your use of this website, or for consequences under federal law, employer policies or another state’s law of using cannabis. Our total liability for any claim arising from your use of this website is limited to $100. This section does not limit any liability that can’t be limited by law, including liability for the professional medical care our practitioners give you.

13. Governing law and disputes

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Loudoun County, Virginia. Before filing a claim, please contact us so we can try to resolve it informally.

14. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date at the top shows when they last changed. Changes apply from that date forward and don’t change fees for visits you’ve already had.

15. General

If any part of these Terms is found unenforceable, the rest stays in effect. If we don’t enforce a right, we haven’t waived it. These Terms work alongside the consent and intake forms you complete as a patient; if they conflict, your signed patient forms control for your medical care.
